Terms of Service

The rules for installing and using EyeWell.

Last updated: July 2026

Welcome to EyeWell. These Terms of Service ("Terms") form a binding agreement between you and the operator of EyeWell ("we", "our", or "the app") and govern your access to and use of the application and related services. Please read them carefully before installing or using the app.

Agreement to Terms

By downloading, installing, accessing, or using the app, you confirm that you have read these Terms and agree to be bound by them. If you do not agree with any part of these Terms, you must discontinue use of the app and uninstall it from your device.

1. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, for personal, non-commercial purposes, in accordance with these Terms and Apple's standard End User License Agreement. You may not:

2. App Functionality

EyeWell is a personal habit tool that helps you take regular breaks from your screen using the 20-20-20 approach — every 20 minutes, look 20 feet away for 20 seconds. You configure an active time window, the days of the week reminders are on, how often breaks occur, and how long each break lasts. The app then schedules local notifications on your device during your active hours only, and displays your daily count, total break time, and streak. All processing runs on your device. There is no account and no sign-in.

3. Subscriptions and Payments

Certain features are available through in-app subscriptions:

4. Notifications

Reminders are delivered as local notifications scheduled by the app on your device. To receive them you must grant notification permission and keep the app installed. Delivery timing depends on system-level settings such as Focus modes, battery optimization, and background activity, all of which are outside our control. Notifications are silent outside the active hours you have configured.

5. Health Disclaimer

EyeWell is a habit and wellbeing aid, not a medical device and not a substitute for professional care. The 20-20-20 approach is a widely referenced practice for reducing digital eye strain, but individual results vary. If you experience persistent eye discomfort, headaches, or vision changes, please consult a qualified eye care professional. Do not rely on EyeWell alone for any medical or vision-related decision.

6. Updates and Availability

We may release updates that add, modify, or remove features at any time, and we may discontinue parts of the app or the service as a whole. We do not guarantee uninterrupted availability or continued access to any specific feature. Some updates may require a current version of iOS or compatible hardware.

7. Disclaimer

The app is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including but not limited to warranties of merchantability, accuracy, reliability, non-infringement, and fitness for a particular purpose.

8. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of or inability to use the app. This includes, without limitation, any missed reminders, streak resets, or data loss resulting from device changes, app updates, or actions you take inside the app. Where liability cannot be excluded under applicable law, our total liability is limited to the amount you paid for related subscriptions during the twelve months preceding the event giving rise to the claim.

9. Termination

We may suspend or terminate your access to the app at any time if these Terms are violated, if continued use creates legal or technical risk, or if the service is discontinued. You may stop using the app at any time by uninstalling it. Sections that by their nature should survive termination — including disclaimers, limitations of liability, and governing law — will continue to apply.

10. Governing Law

These Terms are governed by the applicable laws of the jurisdiction in which the operator is established, without regard to conflict of law principles. Nothing in these Terms limits any non-waivable consumer rights you may have under the laws of your country of residence.
